If you have been injured in an automobile accident or as a pedestrian, and it was the result of someone’s negligence, you may be entitled to recover monetary damages for pain and suffering, payment of reasonable medical expenses incurred or which will be incurred in the future, and lost wages. In order to bring a claim for damages, Massachusetts Law requires the injured person to have one of the following:

(1) $2,000.00 or more in medical bills
(2) A fracture
(3) A scar, or
(4) To have been killed

Medical Bills: In general, the first $2,000.00 in medical bills are paid by the Personal Injury Protection (PIP) insurance carrier. If you have private health care insurance, Massachusetts Law requires that medical bills in excess of $2,000.00 be submitted through your provider for payment. If you do not have private health care insurance, or if your health care insurance company refuses to pay your medical bills, you may be entitled up to $8,000.00 in PIP medical coverage.

Lost Wages: If you loose money because of your inability to work due to your injuries, you may be entitled to collect 75% of your lost wages, based on your average weekly wage, from the PIP carrier, up to $8,000.00.

Insufficient Insurance: If the person who caused your injuries does not have insurance, or inadequate insurance to cover your damages, you may be entitled to collect uninsurance or underinsurance coverage from your automobile policy or a family members automobile policy.


What should I do?
If you have been involved in an automobile accident, or injured as a pedestrian, try to obtain as much information as possible about the vehicles involved in the accident and the driver’s name, address and license number, as well as the owner’s name and address, including their insurance company and coverage information.

Make note of the direction and position of the vehicles, the weather at the time of the accident, the time of day and lighting conditions, and names and addresses of any witnesses.

If you are injured, get medical attention immediately. Although it is not uncommon for symptoms to surface several days later, it is important when you seek medical attention to provide the medical staff with an accurate history of the accident and all of the body parts which are causing pain.

As soon as possible, contact your insurance agent and obtain a coverage selection sheet of the insurance you have on your vehicle and contact your insurance carrier and explain the accident.

It is also a very good idea to obtain photographs of all vehicles involved, as well as visible injuries, and the location of the accident, including any defects in the road, or blocked or obstructed traffic signals. Finally, call a qualified attorney for legal advice on how to handle your claim.
